The new UK Immigration system which has been introduced in stages between 2008/ 2009, consolidates the many complex routes of the old immigration system into just five tiers. We at Gramdan Solicitors LLP can help you with the most relevant and important tiers to businesses.
Tier 1 – For Investors in Business
Tier 1 is for investors who wish to invest and settle in UK. If you have substantial funds to invest in the UK and you genuinely wish to settle in the UK and make it your home you may apply for entry clearance to enter the UK as investors. Under this category you need not work full time running a business here but may engage in self-employment if you so wish. You cannot however, engage in any other employment in the UK. Prior entry clearance in this category is mandatory.
Tier 2 – For Sponsored Skilled Workers
Tier 2 is for sponsored skilled workers and was launched in November 2008. Under this Tier an employer can sponsor an overseas skilled worker provided the employer has a license to sponsor.
Tier 5 – For Sponsored Temporary Workers
Tier 5 is for those organisations who wish to take on temporary workers. This includes Creative and Sporting Workers and Charity Workers and Religious Workers.
Litigation in relation to Illegal Workers
We defend your business if the Border Agency has issued your business a notice under section 15 of the Asylum and Nationality Act 2006.
The Border Agency introduced a civil penalty system for employers on 29 February 2008. This is allowed under section 15 of the Asylum and Nationality Act 2006.
Employers found to be using illegal migrant workers will be served with a notification of potential liability (NOPL) by immigration staff carrying out enforcement and compliance visits. The Illegal Working Civil Penalty Unit will then consider evidence provided by the visiting officer or team and decide whether to issue the employer with a notification of liability (NOL) and a civil penalty of up to £10,000 for each illegal worker.
